Driving therapy contract

This contract is made between Paul Dodd (referred to from now on as “I”) residing at 42a Rea Valley Drive, Northfield, Birmingham, B31 3XE, United Kingdom, and you, the person detailed below (referred to from now on as “You”). These two parties together will be collectively referred to as "The Parties". A consultation is an optional online meeting between us of any length before you sign this contract. A session is an online meeting between us of any length after you have signed this contract. This contract is written under UK law which will apply wherever you are located. 1. Services

This service is to help you overcome driving anxiety. No other services are included.

All sessions are done remotely over the Internet. This does not include any in person work.

This service will not teach you how to drive and no driving lessons are included. It's your responsibility to ensure you have learned to drive safely and follow all the necessary laws, rules and regulations for wherever you are located.

This service is less likely to work if you regularly drink excessive amounts of alcohol (more than 14 units as measured in the UK per week), use any drugs that are not medically prescribed (such as Cannabis or Heroin) or if you are currently in a relationship where you suffer verbal/physical or other forms of abuse.

I will not help you achieve anything that would break any laws or rules such as exceeding the speed limit.

The agreed price of this service is £1,000 (GBP). My ROAD course is included for free.

If you pay in instalments through PayPal, you will be entering a credit agreement with PayPal. Please ensure this is right for you and read PayPal's terms and conditions on their website before continuing.

You must take care when making a payment. If you have a session with me and then say you paid using the wrong card, account, or that you wanted to pay in instalments but paid in full, you must pay again using the correct card, account or payment method before I refund your original payment. You will lose approximately 5% of the original payment due to processing fees.

Sessions must not be recorded in any way. You do not have my permission to post any video or audio of a session online or anywhere else. I will not record or post any session unless you have given me written permission to do so.

Anything you tell me during sessions will be kept strictly confidential. The only exception to this is if you disclose that you have taken part in a crime or are threatening to harm yourself or others. In these instances, I have to report such things to the relevant authorities.

You created your problem, therefore you also have the solution to it. My role is to help guide you to that solution but I can't find it for you, tell you what it is or do anything other than help you find the solution yourself. If you are expecting me to do all the work and fix the problem for you then do not proceed with this therapy because that is not how it works.

You'll have free lifetime access to my online driving anxiety course called ROAD. Lifetime access means you can access the course for as long as it exists, not for as long as you live.

The videos in ROAD are only viewable inside your ROAD account through my website https://www.1stdrive.com/. You will need an internet connection to be able to watch them.

Your access to ROAD may be withdrawn at any time.

2. Sessions

You can have a maximum of three sessions for up to 60 consecutive days from the contract date (today). There must be a minimum of seven consecutive days between each session.

You are not owed sessions or a refund of any amount if you have fewer than three sessions.

Each session is usually up to 60 minutes in length. We may go over this time limit if we are making good progress so always allow spare time after a session.

You can cancel, reschedule or otherwise move each booked session once. If you fail to keep the session for the second time then you will lose that session. If I cancel, reschedule or otherwise move the same session more than once you will be offered a free session in addition to however many remain.

You must send an email to mail@1stdrive.com to cancel, reschedule or in any way alter a session. It is not sufficient to only use links in any emails you may have to make changes to a booking because I often won't receive any notification of the changes and they won't always sync with my diary. A session will only be cancelled or rescheduled once I have replied to that email and I won't attend any sessions that are moved without emailing me. Likewise, I will always email you in the event I need to make changes to a session.

I recommend adding mail@1stdrive.com to your email provider’s safe sender list, also known as a whitelist or safelist. This will make sure all of my emails get to you. If you don’t do this, please check your junk/spam folder because my emails sometimes end up there.

Please make sure you have your camera facing you so that the whole of your face is visible. You must not be holding the device you're using or it could distract you or be dropped so make sure your camera is on a stand, table, tripod etc.

Please do not use any kind of virtual background or blurred background effect during online sessions. These can interfere with the image quality by making your limbs and head disappear at times which is very distracting and makes it difficult for me to see what is happening. Please do not use any filters such as animal ears on your head, smiley faces etc. for the same reasons.

During a session, you must not drink alcohol, smoke, vape or use any kind of device for texting, messaging etc. All alerts on your phone or other devices must be turned off as any distractions may stop you from being able to focus. You must ensure any pets do not interfere and it's best to not have them in the room during a session as your full concentration is required for this to work. If you arrive for a session under the influence of alcohol or drugs then the session will be cancelled.

There must be no other people present during a session. I will not proceed if we begin a meeting and anyone else is in the room because we may be discussing private things and I won't be held accountable for problems caused by revealing these things with others present.

I will only discuss your case with you and if you need help you must contact me yourself. I will not reply to emails or any other form of contact about you sent by your partner, friends, family or anybody else no matter what they say.

My working hours are 9 a.m. to 5 p.m. UK time Monday to Saturday. You must make sure you will be available at these times before signing this contract.

3. Guarantees

There are no guarantees. You may pay for this service and not get the results you want.

4. Driving after a session

Therapy can be extremely emotional for some people and only you can decide when you feel ready to drive afterwards.

If you are unable to drive due to not having access to a vehicle or any other reason (except driving anxiety) you must consider whether this is the right time for you to use this service.

I accept no responsibility for any loss, damage or injury to yourself, others, or any property as a result of your driving after a session. You must take all possible measures to ensure your safety and that of others, especially in situations where you have previously experienced problems when driving.

5. Health declaration and safety measures

By signing this contract you confirm that you do not currently have (and have never had) any mental health issues including, but not limited to, bipolar and schizophrenia. If you have (or have ever had) epilepsy or asthma you must check with a medical professional first. Much of the work I do uses hypnosis which can make any of these conditions worse or bring on an attack.

I am not medically qualified in any way and cannot diagnose medical conditions. It is essential that you exhaust all medical options before taking therapy to ensure the issue is not caused by something I can't help with. Nothing I say must be taken as medical advice or instruction and I can't advise on whether hypnotherapy is suitable for you based on any medication you are taking.

It is your responsibility to make sure you are medically fit to use hypnotherapy. If you are unsure about your suitability for hypnotherapy due to any medical issue, you must check this with a doctor before signing this contract.

You may want to close your eyes for extended periods of time during a session. If you wear contact lenses or anything else that could be affected by this then be sure to remove them before a session begins.

You must make sure you are in a safe location for sessions. I recommend a sturdy chair or bed and you should always be in a situation and location where it would be safe to fall asleep (although this very unlikely to happen).

You must not take any other form of therapy while we work together. Doing so will mean this will not work. If the other therapy is vital to your health and well-being, you must complete that before working with me.

6. Cooling-off period and refunds

You have fourteen days from the day after the contract date (today) to cancel this service. If you cancel during this time by contacting me through the email address mail@1stdrive.com you will be given a refund.

If you do a session during this cooling-off period then you can no longer cancel and will not be owed a refund of any amount.

If you pay through PayPal and need a full refund, you will only get back approximately 95% of the amount you paid. This is due to PayPal charging me fees which are typically around 3% to 5% of the amount you paid. You need to check this amount yourself as their fees vary and could be higher depending on currency, location and other factors.
